This page is the notice and action mechanism of InstantNode under Article 16 of Regulation (EU) 2022/2065 (Digital Services Act). Anyone can use it to report content hosted on our infrastructure that they consider to be illegal. Notices can be submitted electronically at any time and free of charge.

How to submit a notice

Send your notice to [email protected]. So that we can act on it, please include the following:

  • a sufficiently substantiated explanation of the reasons why you consider the content to be illegal;
  • the exact electronic location of the content, in particular the exact URL or URLs and, where necessary, additional information such as an IP address, domain, server name or timestamp;
  • your name and email address, except where the notice concerns an offence referred to in Articles 3 to 7 of Directive 2011/93/EU;
  • a statement confirming your bona fide belief that the information and allegations contained in the notice are accurate and complete.

A notice that contains the elements above allows us to establish the illegality of the content without a detailed legal examination and therefore puts us on actual knowledge within the meaning of Article 6 DSA.

What happens after your notice

  • We confirm receipt without undue delay, provided you have given us an email address.
  • We process the notice in a timely, diligent, non-arbitrary and objective manner.
  • We notify you of our decision and of the redress possibilities available in respect of it. Decisions are not taken by automated means.
  • Where we remove content, disable access to it, restrict it, or suspend or terminate a service, the affected customer receives a clear and specific statement of reasons pursuant to Article 17 DSA, provided we hold their contact details and no statutory obligation prevents this.

Orders from authorities

Orders to act against illegal content (Article 9 DSA) and orders to provide information (Article 10 DSA) should be sent to [email protected]. We will inform the affected customer of the order and of the effect given to it, unless the order or applicable law provides otherwise.

Security vulnerabilities

If you have found a security vulnerability in our platform, please report it to [email protected] before disclosing it publicly, and give us a reasonable period to remedy it. We will not pursue legal steps against good-faith security research that does not access, alter or copy third-party data, does not degrade the service for other customers and is reported to us promptly.

Misuse of this mechanism

Where a sender repeatedly submits manifestly unfounded notices, we may suspend the processing of further notices from that sender for a reasonable period after issuing a prior warning.
