Partner Terms of Service

These Partner Terms of Service ("Partner Terms") govern participation in the InstantNode Partner Program. They apply in addition to the general Terms of Service.

1. Eligibility and Acceptance

Participation is subject to approval by InstantNode. We may approve, reject, suspend, or terminate participation at our discretion in accordance with these Terms and applicable law.

2. Partner Features

Approved partners may receive access to partner-specific features, which can include: partner dashboard access, referral tracking, and partner voucher functionality. Feature availability may change over time.

3. Partner Voucher and Discounts

Partners may create/manage a partner voucher code via the dashboard. According to current platform configuration, referred users may receive a percentage discount (currently 10% as displayed in the dashboard/system).

We may modify discount settings for operational, legal, or commercial reasons.

4. Referral Attribution

Referral attribution is based on platform records (e.g., voucher usage and system tracking records). Only valid, non-fraudulent, non-reversed payments are counted as eligible referral activity.

5. Commissions, Rewards, and Payouts

If commissions/rewards are offered, details are determined by the active partner conditions shown in your dashboard or communicated in writing.

Displayed metrics may be provisional until final validation (fraud checks, refunds, chargebacks, abuse checks). No payout claim arises before final approval.

6. Partner Conduct Rules

Partners must promote services lawfully and transparently. The following is prohibited:

• Misleading claims, deceptive advertising, impersonation, or fake endorsements.
• Spam, mass unsolicited messaging, or abusive promotion methods.
• Self-referrals, fake accounts, or any manipulation of referral tracking.
• Any conduct violating law, platform Terms, or third-party rights.

7. Public Partner Profile

If public partner profile features are used (name/image/link/description), you are responsible for ensuring that your content is lawful and does not infringe third-party rights.

8. Confidentiality and Data Protection

Partner program data (including referral-related user/spending metrics shown to you) is confidential. You may use such data only for legitimate partner program purposes and must not disclose, sell, or misuse it.

You must comply with applicable data protection law (including GDPR where applicable).

9. Intellectual Property

All platform names, logos, and materials remain property of InstantNode or its licensors. Any permitted use is limited to approved partner activities and can be revoked.

10. Suspension and Termination

We may suspend or terminate partner participation for breach, fraud, abuse, legal risk, reputational harm, or security concerns. Upon termination, partner access and voucher functionality may be revoked immediately.

Pending rewards/commissions may be withheld where fraud, abuse, or unresolved chargeback/refund risk exists.

11. Disclaimer and Liability

The Partner Program is provided on an "as is" basis. We do not guarantee specific earnings, traffic, conversions, or business outcomes. Liability follows the limitation framework in the general Terms of Service.

12. Changes to Partner Terms

We may update these Partner Terms at any time for legal, technical, or commercial reasons. Continued participation after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Partner Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory statutory protections.
